The Supreme Court ruled in February 2026 that IEEPA does not authorize tariffs, and new Section 301 tariffs on imports from 60 trading partners took effect on July 24, 2026, so the legal footing has shifted more than once this year.

Refund mechanics are live, with deadlines

CBP’s CAPE refund tool launched on April 20, 2026. According to customs broker M.E. Dey, entries must be unliquidated or within 80 days of liquidation, and finally liquidated entries need a court order. This is a data-preparation problem first. It is not legal advice.

Netstock’s 2026 planning benchmark found that lead-time variability affects 74% of surveyed small and mid-size businesses, and 68% use no alternative procurement strategy.

The same Netstock benchmark reports that dead stock as a share of excess inventory rose from 12% in 2024 to 24% in 2026, tying up cash that small businesses could use elsewhere. It is a vendor survey, so treat it as directional.

Holland & Knight reports that CBP detained 17,651 shipments under the Uyghur Forced Labor Prevention Act from fiscal 2025 through April of fiscal 2026, and that CBP’s June 2026 guidance stresses pre-import due diligence and sub-tier supplier evidence.

Freight and fuel keep pressure on landed cost

In the National Association of Manufacturers’ Q3 2026 outlook survey, 77.3% of respondents cited freight rates and 74.1% cited fuel costs as challenges. Planning with ranges beats planning with point estimates.

Most small firms are still early with AI

Netstock found that 34% of surveyed small and mid-size businesses do not use AI for supply chain planning and 6% use it day to day. Data integrity and security was the top concern at 39%, and 36% said AI gave inconsistent or inaccurate answers.

Deloitte and The Manufacturing Institute estimate 2.3 million technician openings across manufacturing and adjacent industries from 2025 to 2030, and 54.93% of manufacturers in NAM’s Q3 2026 survey cite attracting and retaining a quality workforce as a challenge.
